In order to deeply study and carry out Xi Jinping's thoughts on socialism with Chinese characteristics in the new era, fully implement the spirit of the Second, Third, Fourth and Fifth Plenary Sessions of the 19th National Congress of the Communist Party of China, strengthen the construction of the power production, storage and marketing system, promote the reform of electricity marketization, better play the role of "ballast stone" in medium- and long-term transactions, and ensure the efficient and orderly operation of the electric power market, the following circulars are heeded on the signing of long- and medium-term power contracts in 2021：
一、抓紧签订2021年电力中长期合同
Local government departments, power enterprises and trading institutions should attach great importance to the signing of medium- and long-term power contracts in 2021, do a good job in organizing and coordinating the signing of medium- and long-term power transactions (including priority power generation) contracts between provinces and provinces, and strive to complete the signing of medium- and long-term contracts in the year by the end of December 2020。
二、保障足量签约
（一）充分发挥电力中长期合同的规避风险作用。Local government authorities should encourage market entities to sign medium- and long-term contracts, especially annual and above medium- and long-term contracts, and determine the work goals for signing mid- and long-term contracts for 2021 and above in combination with actual conditions, and strive to contract electricity not less than the average power consumption of the previous three years 80% of the electricity consumption, and through the signing of subsequent monthly contracts to ensure that the contracted electricity in the medium and long-term contracts is not lower than the average electricity consumption of the previous three years。Operating power users and priority power generation enterprises that are not participating in the market shall also sign contracts with users or power generation enterprises in accordance with the relevant requirements for the signing of medium- and long-term contracts。
（二）鼓励市场主体及时、高比例签约。Establish and improve the incentive mechanism for medium- and long-term contract contract performance, and give priority to the user-side market subjects that meet the requirements for medium- and long-term contract performance ratio in 2020 and medium- and long-term contract signing ratio in 2021, and may prioritize contract transfer, adjustment, partial reduction of deviation assessment fees, etc。
（三）保障未参与电力市场交易的经营性电力用户用电。Operating power users who are not involved in the trading of the electricity market shall bear the responsibility of maintaining the bottom power supply by the power grid enterprises, and shall still implement the catalogue sales price。Before re-entering the market, the power users who exit the market shall bear the responsibility of guaranteeing the power supply and implement the electricity price determined by the rules。
三、推动分时段签约
（一）结合各地实际合理划分时段。Market participants in the transaction are encouraged to negotiate, agree on electricity prices by time, and sign medium- and long-term contracts for electricity。Power grid enterprises should provide historical electricity data query services for qualified market subjects, and expand the scope of market subjects to publish more detailed historical electricity consumption curves。Local government departments shall, in accordance with the historical electricity curve of the region, formulate and publish the time-segment classification standards。In the initial stage, the number of time period division does not make mandatory requirements, divided into peak, flat, valley segment signed can be, can also be divided into six to ten paragraphs, with the continuous improvement of the market mechanism gradually refine the time period division。Conditional areas may consider dividing peak months, flat months and trough months by seasonal variation。
（二）提高分时段签约服务水平。Local government departments, together with power grid enterprises, will actively provide power load curves in more industries or regions in the province on the basis of the typical working day and holiday power load curve in the region in 2020 (see annex), and speed up the establishment of a historical electricity information query mechanism for power users for reference when market participants sign contracts。Power users are encouraged to provide their own power load curves and sign medium- and long-term contracts for electricity；To encourage power companies, integrated energy services, etc. to provide a more detailed and accurate power load curve, to help market participants better participate in market transactions。
（三）赋予中小用户自主选择是否签订分时段合同的权利。For qualified power users and power sales companies with annual electricity purchases of more than 5 million kW, the signing of time-between power medium- and long-term contracts is encouraged；Electricity users and power sales companies that purchase less than 5 million kilowatt hours of electricity per year may choose whether or not to sign medium- and long-term contracts for time-between electricity。
（四）明确优先发电计划分时段电量。In formulating the region's annual priority power generation plan, local government departments encourage the determination of priority power generation in accordance with the division of the region's medium- and long-term trading hours, so as to achieve the convergence of priority power generation with the market。For more difficult and accurate forecasting of power sources such as wind power, photovoltaic power generation and hydropower, the requirements may be relaxed appropriately, but the decomposition of electricity during the period should be completed before the monthly production schedule。Cross-provincial priority power generation plans and market-oriented power transmission are also encouraged to determine the time-between electricity generation through consultation between the two sides。
四、拉大峰谷差价
When the two sides sign a time-between contract, they may agree on the price of the peak-valley period, or refer to the average trading price of the past year to determine the flat-segment electricity price, the peak-valley electricity price fluctuates up and down based on the flat-segment electricity price。The up-down floating ratio shall be determined by consultation between the parties to the purchase and sale of electricity, and the relevant standards recommended by the competent government departments may also be implemented。Peak-valley difference as the purchase and sale of electricity between the two sides of the contract of agreement, in the two sides of the electricity distribution jointly implemented, to pull the peak-valley difference。At the beginning of the market, in order to ensure the smooth, healthy and orderly market, local government departments may, according to the needs of the time-phase guidance price, guide price of the peak and valley difference should not be lower than the existing directory price of the peak and valley difference。
五、鼓励签订多年电力中长期合同
All localities may, in conjunction with market rules, give priority to long-term transaction contracts of more than one year, organize and implement them as priority。
六、实现信用机构见签和信用信息共享
The introduction of credit institutions to sign power medium- and long-term trading contracts。To improve the level of collection and application of credit information for power market transactions, all localities should clarify the public credit information center, see the signing of medium- and long-term power trading contracts through the power trading platform of power trading institutions, provide relevant information on the contracts they see, and collect them into the national credit information sharing platform, strengthen the supervision of power credit, and promote the performance of power medium- and long-term contracts。
七、规范签订电力中长期合同
Localities may refer to existing rules to sign medium- and long-term contracts to ensure that the completion of the 2021 mid- to long-term contracts by the end of December is not affected by the trading rules。If there are already rules that need to be revised, local government departments and agencies dispatched by the State Energy Administration shall urgently revise them in accordance with the division of duties。Local government departments should effectively play the role of organization and coordination。The parties to the contract shall, in accordance with the recommended model text of the power medium- and long-term trading contract, consider different market subjects and different types of transactions, actively promote the application, and standardize the signing of contracts。Local government departments should guide power trading institutions and relevant enterprises to complete the adaptive technological transformation of the trading platform and ensure the smooth implementation of the contract signing process。
八、鼓励签订电力中长期电子合同
We will comprehensively promote the platform and electronic operation of medium- and long-term power contracts。We will improve the functions and technical means of trading platforms around the country, encourage market participants to use trading platforms to sign electronic contracts with complete elements, simplify workflow, improve work efficiency and reduce transfer costs。
九、建立健全电力中长期合同签订配套机制
（一）完善电力中长期合同市场化调整机制。In principle, all localities should organize contract transfer transactions by means of bilateral consultations and centralized transactions on a monthly, and gradually shorten the transaction cycle and increase the frequency of transactions, so as to provide market-oriented means for market subjects to adjust the contract power and load curve。Under the premise of prior agreement or entrustment by the contracting party, the medium- and long-term contract load curve of electric power can be adjusted flexibly within the scope of market rules, which can provide the necessary guarantee to increase the proportion of medium- and long-term contract contracts signed in the year。
（二）建立偏差电量结算机制。In the local market rules, the deviation settlement mechanism should be established between the contract power and the actual execution。The deviation settlement mechanism should be conducive to encouraging the market subject to issue electricity consumption plan according to the contract power supply arrangement, and the deviation settlement price mechanism should be clearly defined in the market rules and published to the market subject in advance。For the medium- and long-term contracts signed by the time period, the actual inexperiance of the market subject market is fully taken into account, and the electricity assessment requirements for the time-period deviation should be appropriately relaxed。
（三）理顺中长期交易价格机制。All localities shall strictly implement the government-approved transmission and distribution prices。Electricity trading in principle adopts a price-to-price approach, i.e. the price of electricity for market users consists of electricity energy price, transmission and distribution price, auxiliary service fee, government fund and add-on。Regions that do not have the conditions for the time being should have a clear transition period and move from spread to price surplus as soon as possible。
十、保障电力中长期合同签订工作落实
（一）建立合同签订进展跟踪机制。Local government departments shall, in coordination with the National Energy Administration, send agencies to the National Development and Reform Commission and the State Energy Administration in a timely manner to report the signing of medium- and long-term contracts, reflect relevant issues, and coordinate the work of connecting the signing of medium- and long-term contracts with the spot power。Power trading institutions should establish a medium- and long-term transaction tracking mechanism, track and report to relevant government departments and regulatory agencies on a monthly period of time the signing and performance of medium- and long-term power contracts of various market subjects, and do a good job in disclosing information to market subjects。
（二）完善合同签订工作保障机制。Local government departments should work out medium- and long-term trading programs and do a good job in organizing and implementing them；Power trading institutions shall organize the medium- and long-term market operations in accordance with the trading rules and schemes；Power dispatching agencies do a good job in the medium and long-term transaction safety check, plan implementation and deviation adjustment instructions；Credit institutions do a good job of signing the contract；Market subjects should do a good job in signing and performing medium- and long-term contracts in accordance with the law。Local government departments shall respect the wishes of market subjects, strictly prohibit the appearance of designated transaction prices, trading scale and market subjects, etc., which affect fair competition in the market, and ensure the operation of market norms。
